mySibi Terms and Conditions

Your purchase and use of delivery or related services are subject to the terms and conditions described on this page, the policies we make available in connection with your seller account, and the third-party carrier and other terms available via links below. You agree to these terms and conditions by clicking the check box and/or the "Buy delivery services & confirm dispatch" button presented with these terms and conditions or, if earlier, using any of the services described in these terms and conditions.

Your Purchase. You are purchasing delivery and any related services you request (such as liability cover) from third parties and not from mySibi. mySibi is not responsible for and will not have any liability regarding services you purchase from third parties.

Charges to Seller Account. By purchasing delivery or related services from third parties via your seller account, you agree to pay the fees associated with those services. You authorize us to charge your seller account for any fees associated with the services you purchase (including by offsetting any amounts payable by you against any amounts otherwise payable by us to you). Also, we may seek payment or reimbursement of fees by any other means permitted by your seller agreement or applicable law. We reserve the right to adjust charges after they are initially posted to reflect adjustments by the applicable carrier or other service provider. We may limit or disallow services in our discretion.

Compliance with Laws. You will comply with all applicable laws and regulations with respect to delivery and related third-party services you purchase.

Third-Party Service Terms Apply. Your purchase and use of delivery and related services are also subject to the terms, conditions, and other agreements between you and the applicable carrier or other service provider. You are responsible for reviewing and complying with them.

2. Put the packing slip into the package.
3. mySibi automatically generates a commercial invoice and sends an electronic copy to the carrier using the inputs provided when purchasing the shipping label. For certain countries that don’t support digital commercial invoices, a physical commercial invoice will be provided with the label when purchased through Buy Shipping
4. Attach the shipping label to the package. If a commercial invoice was provided with the shipping label, attach one copy to the package and provide the other to the carrier.
5. Ship your package by one of the following ways:
• requesting a carrier pick-up with DHL
• dropping it off at aDHL drop-off location

International Shipping Terms Conditions

Each item in your order is sold by the merchant that the item is specified as sold by ("Merchant").

• Those items for shipment to countries outside of the U.S. may be subject to taxes, customs duties and fees levied by the destination country ("Import Fees"). The recipient of the shipment is the importer of record in the destination country and is responsible for all Import Fees.
• With respect to each item for which Import Fees have been calculated, you authorize Merchant (as applicable) to designate a carrier ("Designated Carrier") to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise, process and remit your actual Import Fees for such item.
• "Import Fees Deposit" represents an estimate of the Import Fees that will be levied on the items in your order for shipment to countries outside of the U.S. By placing your order, you agree to allow Merchant (as applicable) to collect the Import Fees Deposit for the applicable items in your order. This deposit will be used, on your behalf, to reimburse the Designated Carriers for the import fees that they have paid on your behalf to the appropriate authorities of the destination country.
• You further agree that the Designated Carriers may disclose Merchant (as applicable) the amount of actual Import Fees levied on the item you have purchased from Merchant ("Actual Import Fees"). In the event that the Import Fees Deposit exceeds the Actual Import Fees, Merchant (as applicable) will refund the difference to you.
• In the case of gifts or other purchases made on behalf of another recipient, you also agree to grant the foregoing authorizations on behalf of the recipient designated in your order.
• To obtain details regarding the Actual Import Fees, or to obtain documentation or receipts in connection with customs clearance, you may contact the Designated Carrier specified in your shipment confirmation.
• These terms and conditions are in addition to the standard Conditions of Use of the mySibi website. Pursuant to those terms, title and risk of loss for the items transfer to the recipient upon delivery to the common carrier in the United States.
• • Please note that Merchants participating in the International Direct program may have policies that differ from mySibi terms and conditions. For items you have purchased from a Merchant, please see the applicable Merchant's policies for any other terms and conditions that may apply to your purchase of such items.

Limitations

For products shipped internationally, please note that any manufacturer warranty may not be valid; manufacturer service options may not be available; product manuals, instructions and safety warnings may not be in destination country languages; the products (and accompanying materials) may not be designed in accordance with destination country standards, specifications, and labeling requirements; and the products may not conform to destination country voltage and other electrical standards (requiring use of an adapter or converter if appropriate). You are responsible for assuring that the product can be lawfully imported to the destination country. When ordering from mySibi.com, the recipient is the importer of record and must comply with all laws and regulations of the destination country.

Privacy

Your privacy is important to us, and we know that you care about how information about your order is used and shared. We would like our international customers and customers shipping products internationally to be aware that cross-border shipments are subject to opening and inspection by customs and/or postal authorities.

Also, we may provide certain order, shipment, and product information, such as titles, to our international carriers, and such information may be communicated by the carriers to customs and/or postal authorities in order to facilitate customs clearance and comply with local laws.

If the order is a gift, the package is marked "Gift," but the cost of the item is still stated on the customs form.

Customs authorities require the value of the gift item to be stated directly on the package.

We offer a wide range of mySibi services, and sometimes additional terms may apply. When you use an mySibi marketplace (for example, Your Profile, Purchases, Sales, Financial Services with Resolve, Comments, Communication, and Service) you also will be subject to the guidelines, terms and agreements applicable to that mySibi Marketplace ("Service Terms"). If these Conditions of Use are inconsistent with the Service Terms, those Service Terms will control.

PRIVACY

Please review our Privacy Notice, which also governs your use of mySibi Marketplace, to understand our practices.

ELECTRONIC COMMUNICATIONS

When you use mySibi Marketplace, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other mySibi, such as our Message Center, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT

All content included in or made available through any mySibi Marketplace, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of mySibi or its content suppliers and protected by United States and international copyright laws. The compilation of all content included in or made available through any mySibi is the exclusive property of mySibi and protected by U.S. and international copyright laws.

TRADEMARKS

In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any mySibi Marketplace are trademarks or trade dress of mySibi in the U.S. and other countries. mySibi trademarks and trade dress may not be used in connection with any product or service that is not mySibi, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits mySibi. All other trademarks not owned by mySibi that appear in any mySibi are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by mySibi.

LICENSE AND ACCESS

Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees, mySibi or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the mySibi Marketplace. This license does not include any resale or commercial use of any mySibi Marketplace, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any mySibi or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by mySibi or its licensors, suppliers, publishers, rightsholders, or other content providers. No mySibi, nor any part of any mySibi Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of mySibi. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of mySibi without express written consent. You may not use any meta tags or any other "hidden text" utilizing mySibi's name or trademarks without the express written consent of mySibi. You may not misuse the mySibi. You may use the mySibi only as permitted by law. The licenses granted by mySibi terminate if you do not comply with these Conditions of Use or any Service Terms.

YOUR ACCOUNT

You may need your own mySibi account to use certain mySibi, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. mySibi does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. You must be at least 21 years of age to purchase alcohol, or use any site functionality related to alcohol. mySibi reserves the right to refuse service, terminate accounts, terminate your rights to use mySibi, remove or edit content, or cancel orders in its sole discretion. All products on mySibi are intended for Industrial scale sales and any buyers misrepresenting the reason for buying will be refuse service.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

You may post reviews, comments, photos, videos, and other content; and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. mySibi reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant mySibi a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant mySibi and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify mySibi for all claims resulting from content you supply. mySibi has the right but not the obligation to monitor and edit or remove any activity or content. mySibi takes no responsibility and assumes no liability for any content posted by you or any third party.

INTELLECTUAL PROPERTY COMPLAINTS

mySibi respects the intellectual property of others. If you believe that your intellectual property rights are being infringed, please inform us immediately.

RISK OF LOSS

All purchases of physical items from mySibi are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

RETURNS, REFUNDS AND TITLE

mySibi does not take title to returned items. At our discretion or sellers, a refund may be issued without requiring a return. In this situation, mysibi or seller does not take title to the refunded item.

PRODUCT DESCRIPTIONS

mySibi attempts to be as accurate as possible. However, mySibi does not warrant that product descriptions or other content of any mySibi is accurate, complete, reliable, current, or error-free. If a product offered by mySibi itself is not as described, your sole remedy is to return it in unused condition.

PRICING

"Standard Price" means the suggested price of a product as provided by a seller, manufacturer, or supplier.

With respect to items sold by mySibi, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the correct price of an item sold by mySibi is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item.

We generally do not charge your credit card until after your order has entered the shipping process or, for digital products, until we make the digital product available to you.

SANCTIONS AND EXPORT POLICY

You may not use any mySibi if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are using mySibi. You must comply with all U.S. or other export and re-export restrictions that may apply to goods, ingredients, software (including mySibi Software), technology, and services.

OTHER BUSINESSES

In addition, we provide links to the sites of affiliated companies and certain other businesses. If you purchase any of the products or services offered by these businesses or individuals, you are purchasing directly from those third parties, not from mySibi. We are not responsible for examining or evaluating, and we do not warrant, the offerings of any of these businesses or individuals (including the content of their Web sites). mySibi does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE MYSIBI MARKETPLACE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE MYSIBI MARKETPLACE ARE PROVIDED BY MYSIBI ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. MYSIBI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE MYSIBI, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE MYSIBI, UNLESS OTHERWISE SPECIFIED IN WRITING. DISPUTES

Any dispute or claim relating in any way to your use of any mySibi, or to any products or services sold or distributed by mySibi or through mySibi.com will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to our registered agent Corporation Service Company, 300 Deschutes Way SW, Suite 304, Tumwater, WA 98501. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse those fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, mySibi will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.If for any reason a claim proceeds in court rather than in arbitrationwe each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

APPLICABLE LAW

By using any mySibi Marketplace, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Washington, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and mySibi.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Written claims concerning copyright infringement must include the following information:

• A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;
• A description of the copyrighted work that you claim has been infringed upon;
• A description of where the material that you claim is infringing is located on the site;
• Your address, telephone number, and e-mail address;
• A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
• A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
